Harrison indictments include sex assault, robbery cases

CLARKSBURG -- A 26-year-old man and a 31-year-old woman, accused of sexually assaulting a 14-year-old girl who isn't a relative, have been indicted, Harrison County Prosecutor Joe Shaffer said Thursday.

Grand jurors also indicted a man accused of robbing a dying city resident of his medication and a man accused of leading police on a high-speed chase during rush hour, Shaffer said.

Also indicted were a man accused of robbing a woman of her purse while she was in her car at a strip mall parking lot and a man accused of selling drugs across the street from a Salem elementary school, Shaffer said.

Others were indicted, as well, Shaffer said.

And the prosecutor's office also plans to present a number of cases -- about 20, Shaffer estimated -- for plea bargains without involving grand jurors. That can save taxpayers time and, ultimately, money, Shaffer indicated. He said he hopes to continue to present more cases that way.

In the sex assault case, Gerald Arnett Posey, 26, and Teresa Pauline Posey, 31, both of Reynoldsville, each are charged with three counts of third-degree sexual assault and three counts of conspiracy to commit third-degree sexual assault, Shaffer said. Testimony before the grand jury indicated the Poseys formerly were married.

The Poseys, along with others indicted, are scheduled to be arraigned next Thursday by Chief Circuit Judge John Lewis Marks Jr.

In the other cases:

- Michael L. Hyre, 53, of Clarksburg, is charged in connection with a chase on Meadowbrook Road during rush hour, Shaffer said. Speeds were alleged to have reached 80 miles per hour or above, Shaffer said. Hyre is accused of running several cars off the road, Shaffer added.

Hyre is charged with second-offense driving under the influence and fleeing from an officer in a vehicle while driving under the influence.

- Christopher S. Wilson, 33, of Clarksburg, is accused of invading the home of a dying cancer patient, pushing the man down and stealing his medication, Shaffer said. Wilson was indicted on charges of first-degree robbery, assault and burglary in that case, Shaffer said. In a separate case, Wilson was indicted on two charges of forgery of a credit card, Shaffer said.

- Joseph B. Turner, 42, of Jane Lew, is accused of taking a woman's purse in the Wal-Mart parking lot at Clarksburg's New Pointe Plaza after allegedly telling her he had a gun and would shoot her, Shaffer said. Turner, indicted on a first-degree robbery charge, was alleged to have fled the state and only recently was extradited back to West Virginia from Georgia.

- Michael Chandler, 20, of Salem, is charged with delivery of a controlled substance within 1,000 feet of a school and delivery of a controlled substance, Shaffer said. In the first charge, Chandler allegedly sold marijuana across the street from Salem's Harden Elementary, Shaffer said.

Also indicted Thursday were:

- Charles T. Davis Jr., 26, of Clarksburg, charged with fleeing from an officer while DUI, fleeing from an officer causing bodily harm, second-offense DUI, obstructing an officer, driving while license is suspended for DUI, leaving the scene of an accident causing personal injury and nighttime burglary.

- Gregory R. Greaver, 30, Weston, charged with third-offense DUI, driving while revoked for DUI.

- Debra D. Powers, 45, Clarksburg, charged with third-offense DUI.

- Amanda P. Masters (aka Amanda Gregory), 21, Shinnston, charged with delivery of a controlled substance.

- Dayton W. Ables, 35, Lost Creek, charged with third-offense DUI, second-offense driving on revoked for DUI.

- John J. Jones Jr., 56, Clarksburg, charged with two counts of fleeing from an officer by means other than a vehicle, one count of disorderly conduct, one count of battery on a police officer and one count of attempting to disarm a police officer.

- Dennis P. Albright, 25, Clarksburg, charged with possession with intent to deliver, third-offense driving with a revoked license and fleeing from an officer in a vehicle.

- Michael Mutafis, 43, Clarksburg, charged with five counts of forgery and five counts of uttering.

- Aimee Knotts, 22, Clarksburg, charged with three counts of obtaining a controlled substance by misrepresentation and one count of forgery.

- Brad Phillips, 22, Clarksburg, charged with 74 counts of passing lottery tickets.

- Lori L. Marsh, 26, of Philippi, charged with fraudulent schemes and conspiracy to commit fraudulent schemes.

- Crystal Bowman, 31, Clarksburg, charged with five counts of forgery and five counts of uttering.

- Brian Carpenter, 46, Clarksburg, charged with failure to meet obligation to provide support to a minor.

- Katina Scott, 30, Maple Heights, Ohio, charged with third-offense DUI.

- Rex D. Swiger Jr., 21, Clarksburg, charged with second-offense petit larceny.

- John E. White, 29, Clarksburg, charged with nighttime burglary.

- Tina M. Paugh, 33, Clarksburg, charged with attempting to obtain a controlled substance by misrepresentation.

- Monty R. Williams, 45, Mount Clare, charged with three counts of failure to register or provide notice of registration as sexual offender.

- Richard Nutter, 24, Clarksburg, charged with second-offense petit larceny.

- Eric D. Stein, 33, Washington, Pa., charged with third-offense DUI.

- Michael D. Hyde, 36, Clarksburg, charged with one count of conspiracy to commit forgery and uttering, three counts of uttering and two counts of petit larceny.

- John R. Watson Jr., 36, Clarksburg, charged with 15 counts of forgery, 13 counts of uttering and four counts of petit larceny.

- David Sincel, 49, Shinnston, charged with uttering.

- William Liebau, 21, Parkersburg, charged with threatening to retaliate against a public official for the performance of an official duty.

- Walter C. Jones, 43, Shinnston, charged with two counts of third-offense DUI and two counts of driving while revoked for DUI.

- Jackie G. Miles, 48, Craigsville, charged with failure to meet obligation to provide support to a minor.

- Christopher Knight, 28, Clarksburg, charged with first-degree arson.

- Jesse H. Bell, 39, Shinnston, charged with first-degree arson and burglary.

- Donald A. McClain, 27, Orange, N.J., charged with three counts of forgery and one count of possession with intent to deliver.
